These Terms of Service ("Terms") govern your access to and use of the website located at westcoastpermanentlighting.com (the "Site") and any related services offered by West Coast Permanent Lighting, a d/b/a of Zarlant Trading, LLC ("West Coast Permanent Lighting," "we," "us," or "our"). By accessing or using the Site, requesting an estimate, or otherwise communicating with us through the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

West Coast Permanent Lighting installs permanent outdoor LED lighting systems for residential and commercial properties. These Terms apply to your use of our Site and any online forms, scheduling tools, or communications made available through it. These Terms do not cover the separate written agreement (proposal, estimate, or contract) you sign with us for actual installation work — that agreement, once signed, governs the installation project itself.

2. Eligibility

You must be at least 18 years old to submit a request through this Site or to enter into a service agreement with us. If you are submitting information on behalf of a business, you represent that you are authorized to do so.

3. Requesting an Estimate

Submitting a form on this Site, calling us, or texting us to request a free estimate does not create a binding contract for services. A binding agreement is only formed once both parties sign a separate written proposal or service agreement for your specific project.

4. Communications and SMS Consent

Consent to Receive Messages. By submitting your phone number through this Site, verbally providing consent to our team by phone, or otherwise opting in, you agree to receive calls and text messages from West Coast Permanent Lighting. This consent is specific to West Coast Permanent Lighting and is not shared with or sold to any other company for their own marketing purposes.

Types of Messages. Messages may include appointment confirmations and reminders, service and project updates, and, where you've separately opted in, promotional or marketing messages about our services.

Frequency, Rates, and Opt-Out. Message frequency varies depending on your interaction with us. Message and data rates may apply. You may opt out of text messages at any time by replying STOP to any message, and can request help by replying HELP. Consent to receive text messages is not a condition of purchasing any service.

Carriers. Carriers are not liable for delayed or undelivered messages.

Data Retention. We retain records of your consent and opt-out status for as long as required by applicable law.

5. Accuracy of Information

You agree to provide accurate, current, and complete information when requesting an estimate or otherwise contacting us, including your name, contact information, and property address. We are not responsible for delays or errors resulting from inaccurate information you provide.

6. No Guarantee of Pricing Without an On-Site Estimate

Any pricing information, ranges, or examples referenced on the Site are illustrative only. Actual pricing depends on your property's specific linear footage, the lighting system selected, and other project-specific factors determined during a free on-site estimate. No price is final until reflected in a signed written proposal.

7. Intellectual Property

The Site and its content, including text, graphics, logos, photographs, and design, are owned by or licensed to West Coast Permanent Lighting and are protected by applicable intellectual property laws. You may view and use the Site for your own personal, non-commercial purpose of evaluating or requesting our services. You may not copy, reproduce, distribute, or create derivative works from the Site's content without our prior written permission.

8. Third-Party Links and Services

The Site may link to or integrate with third-party services (for example, scheduling tools, payment processors, or social media platforms). We do not control and are not responsible for the content, policies, or practices of any third-party service. Your use of any third-party service is subject to that party's own terms.

9. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. NOTHING ON THIS SITE CONSTITUTES A WARRANTY REGARDING ANY INSTALLATION WORK; INSTALLATION WARRANTIES, IF ANY, ARE GOVERNED SOLELY BY YOUR SIGNED SERVICE AGREEMENT WITH US.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WEST COAST PERMANENT LIGHTING WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THIS LIMITATION DOES NOT APPLY TO CLAIMS ARISING FROM A SEPARATE SIGNED SERVICE AGREEMENT, WHICH IS GOVERNED BY ITS OWN TERMS.

11. Indemnification

You agree to indemnify and hold harmless West Coast Permanent Lighting, its owners, and employees from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in King County, Washington, and you consent to the jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new "Last Updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
